Trafficking in persons

If you want to complain against a person(s) whom offered, delivered, solicited, accepted, transported, received or lodged an adult for purposes of sexual exploitation, labor exploitation or organ removal, as well as against those who solicited, transported, carried out the accommodation or host of smaller, or delivered, offered or accepted for the same purposes and also against those who, for payment or other consideration offered, delivered, requested or accepted lower, or obtained or provided consent to their adoption or withheld, concealed, destroyed or damaged identification documents or Travel to any of those people.

Art 160 of the Criminal Code

1 – Who offer, give, solicit, accept, transport, store or host person for the purpose of sexual exploitation, labour exploitation or organ removal:

a) by means of violence, kidnapping or serious threat, and

b) by means of deception or manouevre fraudulently;

c) With abuse of authority resulting from a hierarchical relationship of dependence, economic, family or work;

d) Taking advantage of any mental incapacity or vulnerability of the victim, or

e) Upon obtaining the consent of the person who has control over the victim, is punished with imprisonment from three to ten years.

2. The same penalty applies to those who, by any means, solicit, transport, accommodation or proceed to the host of lesser, or deliver, give or accept, for purposes of sexual exploitation, labour exploitation or organ removal.

3 In the case of the preceding paragraph, if the agent using any of the methods provided in subparagraphs of paragraph. 1 or act professionally or for profit, shall be punished with imprisonment from three to twelve years.

4 Who, for payment or other consideration, offer, give, solicit or accept less, or obtains or provide consent for its adoption, shall be punished with imprisonment from one to five years.

5 Whoever, having knowledge of a crime referred to in paragraphs 1 and 2, use the services or bodies of the victim is punished with imprisonment of one to five years if a more severe penalty is not applicable by virtue of another provision.

6 Who retains, conceal, damage or destroy identity documents and travel for victims of crime provided for in paragraphs 1 and 2 is punishable with imprisonment up to three years if a more severe penalty is not applicable by virtue of other statutory provision.
