Summary: Approves the list of countries and international sports competitions to which the rules on air traffic , airports, land and river borders apply.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, Council of Ministers Resolution no. 45-C / 2021, of 30 April, was published, which declares the situation of calamity in the entire continental national territory, and which provides for the rules applicable to air traffic , airports and land and river borders.

In articles 23, 25 and 27 of the aforementioned Resolution of the Council of Ministers, it is established that the members of the Government responsible for the areas of foreign affairs, national defense, internal administration, health and civil aviation define, by dispatch, the lists of countries in respect of which air traffic is restricted , mandatory confinement for the respective passengers and citizens entering national territory by land or river, and the special administrative countries and regions whose list is listed epidemiological situation is in line with Council Recommendation (EU) 2020/912 of 30 June 2020.

Such members of the Government may also determine the list of international professional sporting competitions for the purpose of waiving the obligation of mandatory confinement, regardless of the origin of the respective participants.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B / 2019, of 3 December, in its current wording, of article 17 of Law no. 44/86, of 30 September, and of articles 23, 25 and 27 of Resolution of the Council of Ministers no. 45-C / 2021, of 30 April, the Minister of State and Foreign Affairs, the Minister for National Defense, the Minister for Internal Administration, the Minister for Health and the Minister for Infrastructure and of Housing determine:

1 – To approve, in annex i to this order, which is an integral part, the list of third countries and, as well, of European countries with an incidence rate equal to or greater than 500 cases per 100,000 inhabitants in the last 14 days, drawn up based on information provided by the European Center for Disease Prevention and Control, from which only essential trips are permitted and whose passengers on flights and citizens traveling by land or river must comply, after entering mainland Portugal, a period of prophylactic isolation of 14 days, at home or in a location indicated by health authorities.

2 – To approve, in annex ii to the present order, which is an integral part, the list of European countries with an incidence rate equal to or greater than 150 cases per 100,000 inhabitants in the last 14 days, prepared based on the information provided by the European Center Disease Prevention and Control, from which only essential trips are allowed.

3 – To approve, in annex iii to this order, which is an integral part, the list of countries and administrative regions whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, whose air traffic to and from mainland Portugal is not suspended, subject to confirmation of reciprocity.

4 – To approve, in annex iv to the present order, which is an integral part, the list of international professional sporting competitions, whose participation exception the respective passengers of flights destined to mainland Portugal from the duty to fulfill a period of prophylactic isolation of 14 days , provided that the other conditions provided for in paragraph c) of paragraph 3 of article 25 of the Resolution of the Council of Ministers no. 45-C / 2021, of 30 April are observed.

5 – Annexes i and iv to this order may be updated depending on the evolution of the epidemiological situation by order of the Minister of State and Foreign Affairs, the Minister for National Defense, the Minister for Internal Administration, the Minister for Health and the Minister for Health. Infrastructure and Housing.

6 – The present order takes effect from 00:00 on May 1, 2021 and until 23:59 on May 16, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.

Summary: Approves the list of countries and international sports competitions to which the rules on air traffic, airports and land borders apply.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, Decree No. 7/2021 of 17 April was published, which regulates the declaration of the state of emergency determined by Decree of the President of the Republic no. 41-A / 2021, of April 14, and which now provides for rules applicable to air traffic and airports, as well as land and river borders.

Under the terms of articles 34 to 37 of the aforementioned decree, it is established that the members of the Government responsible for the areas of foreign affairs, national defense, internal administration, health and civil aviation define, by order, the lists of countries in respect of which air traffic is restricted, mandatory confinement for the respective passengers and citizens entering national territory by land is determined and the countries and special administrative regions whose epidemiological situation is in accordance with the Recommendation are listed ( EU) 2020/912 of the Council of 30 June 2020.

Such members of the Government may, furthermore, determine the list of international professional sporting competitions for the purpose of waiving the obligation of mandatory confinement, regardless of the origin of the respective participants.

4 – To approve, in annex iv of the present order, which is an integral part, the list of international professional sports competitions whose participation does not include the respective passengers on flights to mainland Portugal from the duty of fulfilling a period of prophylactic isolation of 14 days provided that the other conditions provided for in paragraph c) of paragraph 2 of article 36 of Decree No. 7/2021, of 17 April are observed.

5 – The present order takes effect from 00:00 on April 19, 2021 and until 23:59 on April 30, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.

SUMMARY

Defines the measures applicable to air traffic to and from mainland Portugal

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, the ban on air traffic to and from Portugal from 17 April 2020 was determined all flights to and from countries that are not part of the European Union, with certain exceptions, through Order No. 3427-A / 2020, of March 18, successively extended until 23:59 on April 15, 2021, taking into account the assessment of the epidemiological situation in Portugal and the European Union and the guidelines of the European Commission.

Taking into account the most recent Union recommendations, concerning the temporary restriction of non-essential travel to the EU and the possible lifting of such restriction, the need to extend air traffic restrictive measures, properly aligned with health concerns, remains currently maintained.

The President of the Republic renewed the declaration of a state of emergency throughout the national territory, through the Decree of the President of the Republic no. 41-A / 2021, of 14 April, with the Government proceeding with its execution, through regulation by Decree 6/2021, of 3 April, which includes rules applicable to air traffic and airports.

In this way, it is important to ensure the adequate regime of authorized air traffic in mainland Portugal, in view of the current epidemiological context.

Thus, in the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B / 2019, of December 3, in its current wording, and of Article 17 of Law No. 44/86, of September 30, in its current wording, the Minister of State and Foreign Affairs, the Minister of National Defense, the Minister of Internal Administration, the Minister of Health and the Minister of Infrastructure and Housing determine:

1 – Suspend air traffic to and from mainland Portugal for all flights, with the exception of flights:

a) From and to the countries that integrate the European Union and the countries associated with the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland), without prejudice to the provisions of paragraph 2;

b) To and from countries and special administrative regions, whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, regarding air links with Portugal and included in the list of annex iii to this order, which is an integral part, subject to confirmation of reciprocity, as well as the entry into Portugal of residents in countries that appear on the list, whenever they have only carried out international transits or transfers at airports located in countries that do not appear in it;

c) From and to countries that are not members of the European Union or that are not countries associated with the Schengen Area, without prejudice to the provisions of paragraph 2;

d) Supporting the return of nationals or the European Union, countries associated with the Schengen Area and nationals of third countries with legal residence in national territory, as well as of a humanitarian nature, who have been recognized by the competent governmental departments. foreign affairs and the competent civil aviation authorities;

e) Intended to allow foreign citizens returning to their respective countries who are in mainland Portugal, provided that such flights are promoted by the competent authorities of such countries, subject to prior request and agreement, and in compliance with the principle of reciprocity.

2 – Notwithstanding the provisions of paragraphs a) and c) of the preceding paragraph, only essential trips originating in countries that are not part of the European Union or that are not countries associated with the Schengen Area and in countries with an incidence rate equal or greater more than 150 cases per 100,000 inhabitants in the last 14 days, which are shown in annexes i and ii to this order, of which they are an integral part, prepared based on information provided by the European Center for Disease Prevention and Control.

3 – Essential trips are considered, namely those designed to allow the transit or entry into Portugal of citizens traveling for professional, study, family reunion, health or humanitarian reasons.

4 – Airlines should only allow passengers to board flights originating in countries referred to in paragraphs a) to d) of paragraph 1, with the exception of children who have not reached the age of 24 months, upon presentation of proof of accomplishment. molecular test by RT-PCR for screening for infection by SARS-CoV-2, with a negative result, performed within 72 hours prior to the time of embarkation.

5 – Passengers on flights originating in South Africa, Brazil or the countries included in Annex I, with an incidence rate equal to or greater than 500 cases per 100,000 inhabitants in the last 14 days, based on information provided by the Center European Disease Prevention and Control, they must comply, after entering Portugal, a period of prophylactic isolation of 14 days, at home or in a place indicated by the health authorities.

6 – Are exempt from complying with the prophylactic isolation provided for in the preceding paragraph, and must limit their respective trips to the essentials for the purpose that motivated their entry into national territory:

a) Passengers traveling on essential journeys and whose period of stay in national territory, attested by a return ticket, does not exceed 48 hours, and must limit their journeys to the essential for the purpose that motivated their entry into national territory;

b) Passengers traveling exclusively for the practice of sporting activities integrated in international professional competitions, listed in annex iv to the present dispatch, which is an integral part of it, provided that compliance with a set of measures appropriate to the maximum reduction of the risks of contagion, namely, avoiding non-sporting contacts, and observance of the rules and guidelines defined by the Directorate-General for Health;

c) Passengers who are part of foreign delegations who travel exclusively to participate in meetings under the Portuguese Presidency of the Council of the European Union.

7 – The provisions of paragraph 5 are applicable to passengers on flights with initial origin in South Africa and Brazil, who have made a stopover or transited through other airports, and to passengers on flights, regardless of origin, who present a registered passport. departure from South Africa and Brazil in the 14 days prior to their arrival in Portugal.

8 – For the purposes of the provisions of paragraphs 5 and 7, airlines shall send the list of passengers to the health authorities in the shortest possible time, without exceeding 24 hours, in order to comply with the provisions of paragraph b) of article 3. Of Decree no. 6/2021, of 3 April, in the event of non-compliance, the administrative offense procedure provided for in paragraph 2, q) of article 2, in conjunction with paragraph 2 of article 3, shall apply. , of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

9 – Nationals or European Union citizens and countries associated with the Schengen Area, as well as nationals of third countries with legal residence in national territory and their families, and diplomats accredited in Portugal, who are passengers on flights provided for in no. 1, and who embark without the test provided for in paragraph 4, are forwarded by the competent authorities, upon arrival in national territory, to carry out the said test, at their own expense, inside the airport in service provided by ANA – Aeroportos de Portugal, SA, through health professionals qualified for the purpose, and this service may be subcontracted, where they wait until the notification of the result, and incur the infraction provided for in paragraph q) of article 2, in conjunction with paragraph 3 of article 3 of Decree-Law no. 28-B / 2020,of June 26, in its current wording.

10 – Citizens of third country nationals without legal residence in national territory who embark without the test referred to in paragraph 4 must be refused entry into national territory.

11 – Foreign citizens without legal residence in the national territory who make a stopover at a national airport must wait for a connecting flight to the respective countries in their own place inside the airport.

12 – Airlines that allow passengers to board without the test referred to in paragraph 4 incur the infraction provided for in paragraph q) of article 2, in conjunction with paragraph 2 of article 3, of Decree-Law 28-B / 2020, of 26 June, in its current wording.

13 – The fine provided for in the preceding paragraph before the departure of nationals and foreigners with legal residence in national territory and their family members, under the terms of Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, and diplomats accredited in Portugal, without the test referred to in paragraph 4 on flights originating in Portuguese-speaking African countries and on flights to support the return of national citizens or holders of residence permits in mainland Portugal or of a humanitarian nature.

14 – Within the scope of monitoring compliance with the provisions of paragraph 7, it is the responsibility of the Aliens and Borders Service to verify the country where the passengers performed the molecular test by RT-PCR and, confirming to be in South Africa or Brazil , communicate the data collected to the health authorities to comply with the provisions of paragraph b) of article 3 of Decree No. 6/2021, of 3 April, through the sef.travel.pt platform.

15 – The oversight of the provisions of this order is the responsibility of the Foreigners and Borders Service, in collaboration with the Public Security Police.

16 – The interdictions resulting from this order are not applicable to State aircraft and the Armed Forces, to aircraft that integrate or will integrate the Special Device for Fighting Rural Fires, flights for the exclusive transportation of cargo and mail, of emergency medical and technical scales for non-commercial purposes.

17 – The duties arising from this order are not applicable to crew members of aircraft.

18 – The Minister for Internal Administration and the Minister for Health may adopt, through a joint order, specific health control measures that are necessary depending on the origin of the flights and the assessment of the epidemiological situation by the European Center for Disease Control and Prevention .

19 – The present order takes effect from 00:00 on April 16, 2021 (midnight 15th/16th) and until 23:59 on April 18, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.

Summary: Defines the measures applicable to air traffic to and from mainland Portugal.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, the ban on air traffic to and from Portugal from 17 April 2020 was determined all flights to and from countries that are not part of the European Union, with certain exceptions, through Order No. 3427-A / 2020, of March 18, successively extended until 23:59 on March 31, 2021, taking into account the assessment of the epidemiological situation in Portugal and the European Union and the guidelines of the European Commission.

Taking into account the most recent Union recommendations, concerning the temporary restriction of non-essential travel to the EU and the possible lifting of such restriction, the need to extend air traffic restrictive measures, properly aligned with health concerns, remains currently maintained.

The President of the Republic renewed the declaration of a state of emergency throughout the national territory, through the Decree of the President of the Republic no. 31-A / 2021, of 25 March, with the Government proceeding with its execution, through regulation by Decree No. 4/2021, of 13 March, in its current wording, which includes rules applicable to air traffic and airports.

In this way, it is important to ensure the adequate regime of authorized air traffic in mainland Portugal, in view of the current epidemiological context.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B / 2019, of December 3, in its current wording, and of Article 17 of Law No. 44/86, of September 30, in its current wording, the Minister of State and Foreign Affairs, the Minister of National Defense, the Minister of Internal Administration, the Minister of Health and the Minister of Infrastructure and Housing determine:

1 – Suspend all flights, commercial or private, from airports or aerodromes in mainland Portugal, with origin or destination in Brazil and the United Kingdom.

2 – The suspension referred to in the preceding paragraph does not affect flights of a humanitarian nature, recognized by the competent services of the governmental area of ​​foreign affairs and by the competent authorities in matters of civil aviation, for the purposes of:

a) Repatriation of nationals, the European Union and countries associated with the Schengen Area, and their family members, pursuant to Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, as well as nationals from third countries with legal residence in national territory;

b) Repatriation of foreign nationals who are in mainland Portugal.

3 – Passengers covered by subparagraph a) of the previous number are obliged, cumulatively, to:

a) Submit proof of carrying out a molecular test by RT-PCR to screen for SARS-CoV-2 infection, with a negative result, performed within 72 hours prior to the time of embarkation, with the exception of children who have not completed 24 months of age ;

b) Comply, after the entry, with a period of prophylactic isolation of 14 days, at home or in a place indicated by the health authorities, or wait for the flight to the countries of destination in a proper place inside the airport.

4 – The provisions of the preceding paragraph are applicable to passengers on flights with initial origin in the United Kingdom or Brazil, who have made a stopover or transit through countries whose air traffic to Portugal is authorized.

5 – The provisions of paragraph 3 are also applicable to passengers on flights with initial origin in South Africa, who have made a stopover or transit in countries whose air traffic to Portugal is authorized, and to passengers on flights , regardless of origin, who present a passport with a record of leaving South Africa in the 14 days prior to their arrival in Portugal.

6 – For the purposes of the provisions of paragraphs 4 and 5, airlines shall send, in the shortest possible time, without exceeding 24 hours after arrival in mainland Portugal, the list of passengers whose transit from the United Kingdom, the Brazil or South Africa is aware of it to the health authorities, in order to comply with the provisions of paragraph b) of article 3 of Decree No. 4/2021, of 13 March, in its current wording, being applicable, in the event of non-compliance, the administrative offense provided for in paragraph q) of article 2, in conjunction with paragraph 2 of article 3 of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

7 – Suspend air traffic to and from mainland Portugal for all flights, with the exception of flights:

a) From and to the countries that integrate the European Union and the countries associated with the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland), without prejudice to the provisions of paragraphs 8 and 9;

b) To and from countries and special administrative regions, whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, regarding air links with Portugal and included in the list of annex iii to this order, which is an integral part, subject to confirmation of reciprocity, as well as the entry into Portugal of residents in countries that appear on the list, whenever they have only carried out international transits or transfers at airports located in countries do not appear in it;

c) To and from countries that are not members of the European Union or that are not countries associated with the Schengen Area, exclusively for essential trips without prejudice to the provisions of paragraph 1;

d) Supporting the return of nationals or the European Union, countries associated with the Schengen Area and nationals of third countries with legal residence in national territory, as well as of a humanitarian nature, who have been recognized by the competent governmental departments. foreign affairs and the competent civil aviation authorities;

e) Aimed at allowing foreign citizens returning to their respective countries who are in mainland Portugal, provided that such flights are promoted by the competent authorities of such countries, subject to prior request and agreement, and in compliance with the principle of reciprocity.

8 – Without prejudice to the provisions of paragraph a) of the preceding paragraph, only essential trips originating in countries with an incidence rate equal to or greater than 500 cases per 100,000 inhabitants in the last 14 days, which are set out in Annex I hereto, are allowed dispatch, of which it forms an integral part, prepared on the basis of information provided by the European Center for Disease Prevention and Control.

9 – Only essential trips originating in countries with an incidence rate equal to or greater than 150 cases and less than 500 cases per 100,000 inhabitants in the last 14 days are allowed, which are listed in annex ii to this order, of which it is an integral part , drawn up on the basis of information provided by the European Center for Disease Prevention and Control.

10 – Essential journeys are considered, under the terms referred to in Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, namely those designed to allow the transit or entry or departure from Portugal of:

a) Citizens of the European Union, nationals of States associated with the Schengen Area and their family members, pursuant to Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, and third-country nationals with legal residence in a Member State of the European Union;

b) Third-country nationals traveling for professional, study, family reunion, health or humanitarian reasons.

11 – Passengers on flights originating in countries referred to in paragraphs a) to d) of paragraph 7, with the exception of children who have not reached 24 months of age, only embark on presentation of proof of conducting a molecular test by RT- PCR for screening for SARS-CoV-2 infection, with a negative result, performed within 72 hours prior to the time of embarkation.

12 – Passengers on flights originating in countries belonging to the European Union and countries associated with the Schengen Area listed in Annex I must comply, after entering continental Portugal, for a period of prophylactic isolation of 14 days, at home or at a place indicated by health authorities.

13 – Passengers traveling on essential trips and whose period of stay in national territory, attested by a return ticket, do not exceed 48 hours are excluded from complying with the prophylactic isolation provided for in the preceding paragraph, and must limit their travel to what is essential for the end that motivated the entry into national territory.

14 – For the purposes of subparagraph b) of paragraph 3 and paragraph 12, airlines send the list of passengers to the health authorities in the shortest possible time, without exceeding 24 hours, in order to comply with the provisions of paragraph b) of article 3 of Decree no. 4/2021, of 13 March, in its current wording, being applicable, in case of non-compliance, the infraction process provided for in paragraph q) of article 2, in conjunction with no. 2 of article 3, of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

15 – Nationals or European Union citizens and countries associated with the Schengen Area, as well as nationals of third countries with legal residence in national territory and their families, and diplomats accredited in Portugal, who are passengers on flights provided for in paragraphs no. paragraphs 2 and 7, and who embark without the test provided for in paragraph a) of paragraph 3 and in paragraph 11, are forwarded by the competent authorities, upon arrival in national territory, to carry out the said test, at their own expense , inside the airport in service provided by ANA – Aeroportos de Portugal, SA, through health professionals qualified for this purpose, and this service can be subcontracted, where they wait until the notification of the result, and incur in the administrative offense provided for in paragraph q) Article 2, in conjunction with Article 3 (3),of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

16 – Nationals of third countries without legal residence in national territory who embark without the test referred to in paragraph 11 must be refused entry to national territory.

17 – Foreign citizens without legal residence in the national territory who make a stopover at a national airport must wait for a connecting flight to the respective countries in their own place inside the airport.

18 – Airlines that allow passengers to board without the test referred to in paragraph a) of paragraph 3 and in paragraph 11 incur the infraction provided for in paragraph q) of article 2, in conjunction with paragraph 2 of article 3, of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

19 – The fine provided for in the preceding paragraph before the departure of nationals and foreigners with legal residence in national territory and their family members, under the terms of Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, and diplomats accredited in Portugal, without the test referred to in paragraph 11 on flights originating in Portuguese-speaking African countries and on flights to support the return of national citizens or holders of residence permits in mainland Portugal or of a humanitarian nature.

20 – Within the scope of monitoring compliance with the provisions of paragraphs 4 and 5, it is the responsibility of the Aliens and Borders Service to verify the country where the passengers performed the molecular test by RT-PCR and, confirming that it is in the United Kingdom, Brazil or South Africa, send, in the shortest possible time, without exceeding 24 hours after arrival in mainland Portugal, the respective list of passengers to the health authorities to comply with the provisions of paragraph b) of article 3. of Decree No. 4/2021, March 13, in its current wording.

21 – The oversight of the provisions of this order is the responsibility of the Foreigners and Borders Service, in collaboration with the Public Security Police.

22 – The interdictions resulting from this order are not applicable to State aircraft and the Armed Forces, to aircraft that integrate or will integrate the Special Rural Fire Fighting Device, to flights for the exclusive transportation of cargo and mail, of emergency medical and technical scales for non-commercial purposes.

23 – The duties arising from this order are not applicable to aircraft crew.

24 – The provision in paragraph b) of no. 3 is also applicable to the entry of nationals or those legally resident in national territory from the United Kingdom, Brazil, South Africa or the countries included in annex i, across land borders, and the SEF must communicate the citizens’ identification data to the health authorities in order to comply with the provisions of paragraph b) of article 3 of Decree no. 4/2021, 13 March, in its current wording.

25 – The Minister for Internal Administration and the Minister for Health may adopt, through a joint order, specific health control measures that are necessary depending on the origin of the flights and the assessment of the epidemiological situation by the European Centre for Disease Prevention and Control .

26 – The present order takes effect from 00:00 on April 1, 2021 (midnight 31st March/1st April) and until 23:59 on April 15, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.

4 – The provisions of the preceding paragraph are applicable to passengers on flights with initial origin in the United Kingdom or Brazil, who have made a stopover or transit through countries whose air traffic to Portugal is authorized.

5 – For the purposes of the preceding paragraph, airlines shall, in the shortest possible time, not exceed 24 hours after arriving in mainland Portugal, the list of passengers whose transit from the United Kingdom or Brazil is their own to the health authorities, in order to comply with the provisions of subparagraph b) of article 3 of Decree no. 3-F / 2021, of 13 March, in its current wording, the process being applicable in case of non-compliance an administrative offence provided for in paragraph q) of article 2, in conjunction with paragraph 2 of article 3 of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

6 – Authorize air traffic to and from mainland Portugal for all flights:

a) From and to the countries that integrate the European Union and the countries associated with the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland), recommending that only essential trips be made to and from the countries mentioned in annexes i and ii to this order, of which they are an integral part;

b) To and from countries and special administrative regions, whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, regarding air links with Portugal and included in the list of annex iii to this order, which is an integral part, subject to confirmation of reciprocity, as well as the entry into Portugal of residents in countries that appear on the list, whenever they have only carried out international transits or transfers at airports located in countries that do not appear in it;

7 – Essential journeys are considered, under the terms referred to in Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, namely those intended to allow the transit or entry or departure from Portugal of:

a) Citizens of the European Union, nationals of States associated with the Schengen Area and their family members, pursuant to Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, and third-country nationals with legal residence in a Member State of the European Union;

b) Third-country nationals traveling for professional, study, family reunion, health or humanitarian reasons.

Summary: Defines the measures applicable to air traffic to and from mainland Portugal.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, the ban on air traffic to and from Portugal from 17 April 2020 was determined. all flights to and from countries that are not part of the European Union, with certain exceptions, through Order No. 3427-A / 2020, of March 18, successively extended until 23:59 on March 1, 2021, taking into account the assessment of the epidemiological situation in Portugal and the European Union and the guidelines of the European Commission.

Taking into account the most recent Union recommendations, concerning the temporary restriction of non-essential travel to the EU and the possible lifting of such restriction, the need to extend air traffic restrictive measures, properly aligned with health concerns, remains currently maintained.

The President of the Republic renewed the declaration of a state of emergency throughout the national territory, through the Decree of the President of the Republic no. 21-A / 2021, of 25 February, with the Government proceeding with its execution, through regulation by Decree 3-F / 2021, of February 26, which includes rules applicable to air traffic and airports.

In this way, it is important to ensure the adequate regime of authorized air traffic in mainland Portugal, in view of the current epidemiological context.

Thus, in the conjugated terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B / 2019, of December 3, in its current wording, and of Article 17 of Law No. 44/86, of September 30, in its current wording, the Minister of State and Foreign Affairs, the Minister of National Defense, the Minister of Internal Administration, the Minister of Health and the Minister of Infrastructure and Housing determine:

1 – Suspend all flights, commercial or private, from airports or aerodromes in mainland Portugal, with origin or destination in Brazil and the United Kingdom.

2 – The suspension referred to in the preceding paragraph does not affect flights of a humanitarian nature, recognized by the competent services of the governmental area of ​​foreign affairs and by the competent authorities in matters of civil aviation, for the purposes of:

a) Repatriation of nationals, the European Union and countries associated with the Schengen Area, and their family members, pursuant to Directive 2004/38 / EC of the European Parliament and of the Council of 29 April 2004, as well as nationals from third countries with legal residence in national territory;

b) Repatriation of foreign nationals who are in mainland Portugal.

3 – Passengers covered by subparagraph a) of the previous number are obliged, cumulatively, to:

a) Present proof of carrying out a molecular test by RT-PCR for screening for infection by SARS-CoV-2, with a negative result, performed within 72 hours prior to the time of embarkation, except for children who have not completed 24 months of age ;

b) Comply, after the entry, with a period of prophylactic isolation of 14 days, at home or in a place indicated by the health authorities, or wait for the flight to connect the respective countries in a proper place inside the airport.

4 – Authorize air traffic to and from mainland Portugal for all flights:

a) From and to the countries that integrate the European Union and the countries associated with the Schengen Area (Liechtenstein, Norway, Iceland and Switzerland), recommending that only essential trips be made to and from the countries mentioned in annexes i and ii to this order, of which they are an integral part;

b) To and from countries and special administrative regions, whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, regarding air links with Portugal and included in the list of annex iii to this order, which is an integral part, subject to confirmation of reciprocity, as well as the entry into Portugal of residents in countries that appear on the list, whenever they have only carried out international transits or transfers at airports located in countries that do not appear in it;

c) To and from countries that are not members of the European Union or that are not countries associated with the Schengen Area, exclusively for essential trips;

d) Supporting the return of nationals or the European Union, countries associated with the Schengen Area and nationals of third countries with legal residence in national territory, as well as of a humanitarian nature, who have been recognized by the competent governmental departments, foreign affairs and the competent civil aviation authorities;

e) Aimed at allowing foreign citizens returning to their respective countries who are in mainland Portugal, provided that such flights are promoted by the competent authorities of such countries, subject to prior request and agreement, and in compliance with the principle of reciprocity.

5 – Essential journeys are considered, under the terms referred to in Council Recommendation (EU) 2020/912, of 30 June 2020, and respective updates, namely those intended to allow the transit or entry or departure from Portugal of:

a) Citizens of the European Union, nationals of States associated with the Schengen Area and their family members, pursuant to Directive 2004/38 / EC of the European Parliament and of the Council of 29 April 2004, and third-country nationals with legal residence in a Member State of the European Union;

b) Third-country nationals traveling for professional, study, family reunion, health or humanitarian reasons.

6 – Passengers on flights originating in countries referred to in paragraphs a) to d) of paragraph 4, with the exception of children who have not reached 24 months of age, only embark upon presentation of proof of conducting a molecular test by RT- PCR for screening for SARS-CoV-2 infection, with a negative result, performed within 72 hours prior to the time of embarkation.

7 – Passengers on flights originating in countries belonging to the European Union, and countries associated with the Schengen Area, with an incidence rate equal to or greater than 500 cases per 100,000 inhabitants in the last 14 days, which are listed in Annex I, prepared based on the information provided by the European Center for Disease Prevention and Control, they must comply, after entering continental Portugal, with a period of prophylactic isolation of 14 days, at home or in a place indicated by health authorities.

8 – Passengers traveling on essential journeys and whose period of stay in national territory, attested by a return ticket, do not exceed 48 hours are excluded from complying with the prophylactic isolation provided for in the previous paragraph, and must limit their travel to what is essential for the end that motivated the entry into national territory.

9 – For the purposes of subparagraph b) of paragraph 3 and paragraph 7, airlines submit the list of passengers to the health authorities in the shortest possible time, without exceeding 24 hours, in order to comply with the provisions of paragraph b) of article 3 of Decree no. 3-A / 2021, of January 14, in its current wording, being applicable, in case of non-compliance, the infraction process provided for in paragraph q) of article 2. , in conjunction with paragraph 2 of article 3 of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

10 – Nationals or European Union citizens and countries associated with the Schengen Area, as well as nationals of third countries with legal residence in national territory and their families, and diplomats accredited in Portugal, who are passengers on flights provided for in paragraphs no. paragraphs 2 and 4, and who embark without the test provided for in paragraph a) of paragraph 3 and in paragraph 6, are forwarded by the competent authorities, upon arrival in national territory, to carry out said test, at their own expense , inside the airport in service provided by ANA – Aeroportos de Portugal, SA, through health professionals qualified for this purpose, and this service can be subcontracted, where they wait until the notification of the result, and incur in the administrative offense provided for in paragraph q) Article 2, in conjunction with Article 3 (3),of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

11 – Citizens of third-country nationals without legal residence in national territory who embark without the test referred to in paragraph 6 must be refused entry to national territory.

12 – Foreign citizens without legal residence in national territory who make a stopover at a national airport must wait for a connecting flight to the respective countries in their own place inside the airport.

13 – Airlines that allow passengers to board without the test referred to in paragraph a) of paragraph 3 and in paragraph 6 incur the infraction provided for in paragraph q) of article 2, in conjunction with paragraph 2 of article 3, of Decree-Law no. 28-B / 2020, of 26 June, in its current wording.

14 – The fine provided for in the preceding paragraph before the departure of nationals and foreigners with legal residence in national territory and their family members, under the terms of Directive 2004/38 / EC of the European Parliament and of the Council, of 29 April 2004, and diplomats accredited in Portugal, without the test referred to in paragraph 6 on flights originating in Portuguese-speaking African countries and on flights to support the return of national citizens or holders of residence permits in mainland Portugal or of a humanitarian nature.

15 – The oversight of the provisions of this order is the responsibility of the Aliens and Borders Service, in collaboration with the Public Security Police.

16 – The prohibitions resulting from this order are not applicable to State aircraft and the Armed Forces, to aircraft that integrate or will integrate the Special Device for Fighting Rural Fires, flights for the exclusive transportation of cargo and mail, of emergency medical and technical scales for non-commercial purposes.

17 – The duties arising from this order are not applicable to aircraft crew.

18 – The Minister for Internal Administration and the Minister for Health may adopt, through a joint order, specific health control measures that are necessary depending on the origin of the flights and the assessment of the epidemiological situation by the European Center for Disease Prevention and Control .

19 – The present order takes effect from 00:00 on March 2, 2021 and until 23:59 on March 16, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.
