Summary: Determines border control procedures by SEF.

Bearing in mind the provisions of the Decree of the President of the Republic no. 14-A / 2020, of 18 March, namely paragraph d) of article 4, in conjunction with the provisions of the Resolution of the Council of Ministers no. 10-B / 2020, of 16 March, and Decree No. 2-A / 2020, of 20 March, as well as in the guidelines contained in the European Commission’s communication of 16 March 2020 regarding the coordinated decision restoring a travel restriction non-essential for the European Union for the period of 30 days that is being adopted in the Member States, it is determined, without prejudice to new guidelines, namely from the Directorate-General for Health, and in the exercise of the powers of the SEF, regarding the control of border:

a) At the external air border, SEF exercises border control of flights from third countries that have not been suspended.

In the legal terms mentioned above, which determined the declaration of the current state of national emergency, the entry of passengers by SEF in Portugal will be authorized, and whenever the obligations imposed by the Directorate-General for Health are fulfilled only to the following categories of passengers:

i) To nationals of a Member State of the European Union, of Schengen associated countries authorized under the terms of no. 1 of Order no. 3427-A / 2020, of 18 March, and members of their families under the terms of the Directive 2004/38 / EC of the Parliament and the Council;

ii) Passengers on flights from Portuguese-speaking countries, South Africa, Canada, the United States of America, the United Kingdom and Venezuela, authorized under the terms of no. 1 of Order no. 3427- A / 2020, of March 18, and provided that the reciprocity of treatment in the countries referred to Portuguese citizens is ensured;

iii) Citizens with a residence permit;

iv) To health professionals and health researchers and humanitarian aid workers, as long as they are exercising their functions;

v) Persons qualified with an identification document issued by the Ministry of Foreign Affairs under the terms of article 87 of Law no. 23/07, of 4 July, in its current wording;

vi) Citizens repatriated through the consular assistance mechanism;

vii) Applicants for international protection;

viii) Citizens traveling for urgent professional reasons, duly proven;

ix) To nationals of Portuguese-speaking countries within the scope of health protocols signed for urgent and urgent medical acts;

x) Citizens whose entry is justified on humanitarian grounds.

Those responsible for air border posts at national airports immediately inform air carriers of the entry into force of these procedures.

SEF sends immediate communication to all embassies in third countries, accredited in Portugal.

SEF gives immediate notice to SEF immigration liaison officers in Angola, Brazil, Cape Verde and Guinea-Bissau, who must take all necessary steps to publicize the present procedures with local air carriers and similar services.

The entry into force of these procedures is subject to a transitional period of 24 hours from their publication, in order to safeguard the rights of passengers who, in the meantime, have already boarded at the point of origin.

b) Dispatch No. 3298-C / 2020, dated March 13, and Resolution of the Council of Ministers No. 10-B / 2020, dated March 16, apply to the maritime border;

c) At the land border, the Resolution of the Council of Ministers no. 10-B / 2020, dated March 16, applies.

Passengers authorized to enter national territory are required to comply with the guidelines issued by the Directorate-General for Health.
