1,The Council of Ministers today approved the resolution extending the declaration of the situation of calamity, throughout the national continental territory, until 23h59 on 23 November.

With regard to municipalities at high risk, the decree states that

  • from 00h00 on 13 November, the following municipalities are no longer on the list of those at high risk: Batalha, Mesão Frio, Moimenta da Beira, Pinhel, São João da Pesqueira, Tabuaço and Tondela;

  • it is stipulated that, during the weekend, from 13h00, restaurants may only operate for home delivery.

 

2. A diploma has also been approved establishing an extraordinary support measure for the catering sector within the framework of the operating restrictions approved under the state of emergency decreed on 6 November.

 

3. The decree-law extending the social tariff for electricity and the social tariff for natural gas to more situations of social and economic insufficiency has been approved.

This law promotes the extension of the conditions of access to the social tariff for electricity and natural gas to situations of unemployment, thus adding to the list of economically vulnerable end-customers the beneficiaries of unemployment benefits. It also extends to more situations of vulnerability: the beneficiaries of the disability social pension of the special regime of protection in disability or of the supplement to the social benefit for inclusion.

Communiqué of the extraordinary Council of Ministers of 7 November 2020

  1. The Council of Ministers approved today the decree implementing the declaration of a state of emergency made by the President of the Republic lasting 15 days, from 00h00 on 9 November to 23h59 on 23 November. It is thus determined:

 

  • a ban on circulation, in certain councils with high risk, in public spaces and streets daily between 23h00 and 05h00, and on Saturdays and Sundays between 13h00 and 05h00, except for urgent and unavoidable journeys;
  • the possibility of taking body temperature measurements, by non-invasive means, in controlling access to the workplace, public services or institutions, educational establishments and commercial, cultural or sporting spaces, means of transport, in residential structures, health establishments, prisons or educational centres, and access to the controlled location may be prevented whenever there is a refusal to take body temperature measurements, or the person presents a result higher than the normal body temperature;
  • the following may be subject to the performance of SARS-CoV-2 diagnostic tests: staff, patients and visitors to health care establishments and residential structures for the elderly, integrated continuous care units of the National Network of Integrated Continuous Care and other responses dedicated to the elderly, children, young people and people with disabilities, workers of the Prison Guard Corps, prisoners and young people admitted to educational centres and their respective visitors, staff, students and visitors from educational and teaching establishments and higher education institutions, those who wish to enter or leave national territory by air or sea, as well as those who wish to access places determined for this purpose by the DGS;
  • strengthening the screening capacity of public health authorities;
  • the possibility of requisitioning the private and social sector;
  • mobilisation of human resources to control the pandemic.

Communiqué of the extraordinary Council of Ministers of 31 October 2020

 

1,The Council of Ministers approved today the resolution renewing the calamity situation throughout mainland Portugal, from 00h00 on 4 November 2020 until 23h59 on 15 November 2020, and, in view of the epidemiological situation in Portugal, extends to other municipalities the special measures that had been established for the municipalities of Felgueiras, Lousada and Paços de Ferreira, with some additional changes.

The special measures adopted for those municipalities now cover new municipalities taking into account the following criteria: firstly, a quantitative criterion, according to the number of cases per 100,000 inhabitants; secondly, a qualitative criterion, according to the proximity to another municipality that meets the quantitative criterion.

This is what is determined:

The duty to remain at home, with citizens being required to refrain from circulating in public spaces and streets, as well as in private spaces and streets assimilated to public roads, except for all journeys previously authorised, to which are added journeys for activities carried out in day centres, to visit users in residential structures for the elderly and for people with disabilities, integrated continuous care units of the National Network of Integrated Care or other responses dedicated to elderly people, as well as trips to post offices, bank branches and insurance or insurance brokers’ agencies and trips necessary to leave continental national territory;

It is determined, as a rule, that all retail and service establishments, as well as those in commercial complexes, close by 22h00;

10.30 p.m. is defined as the closing time of restaurants;

It is now provided that the mayor of the municipality with territorial jurisdiction may set a closing time lower than the ceiling, subject to the assent of the local health authority and the security forces;

It is stipulated that celebrations and other events involving a crowd of more than five people are prohibited, unless they belong to the same household, and that fairs and markets are prohibited, with religious ceremonies and shows being permitted in accordance with the rules of the Directorate-General for Health;

It is stipulated that the teleworking regime must be adopted, regardless of the employment situation, whenever the duties in question allow it, unless the worker is prevented from doing so;

It is determined that the exceptional and transitory regime of work reorganisation (contained in DL 79-A/2020) is applicable to companies with workplaces with 50 or more workers, in the territorial areas of the municipalities identified in annex II of the RCM (currently this regime was applicable to the metropolitan areas of Lisbon and Porto).

Besides the exceptional measures described above, the number of people in each group in restaurants is limited to six, for the whole national territory, unless they belong to the same family.

In the remaining continental national territory, the regime of the calamity situation that was defined continues to apply.

  1. A decree has been passed approving the following exceptional and temporary measures in the context of the Covid-19 disease pandemic:
  • Approves an exceptional regime for hiring health professionals for the intensive care units of the National Health Service;
  • Approves an exceptional regime for hiring retired nurses to work in the public health units of the Regional Health Administrations, I.P. and Local Health Units, E.P.E;
  • Approves an exceptional regime applicable to the mandates of the highest management bodies of the health units that make up the National Health Service;
  • creates the provisional declaration of preventive prophylactic isolation following contact with the Contact Centre of the National Health Service (SNS24);
  • Establishes an exceptional and temporary regime of telework, unless the worker is prevented from doing so, in territories to be defined by a Resolution of the Council of Ministers;
  • Extends the maximum duration of effective service under a military contract until 30 June 2021;
  • Extends the deadline for informing the register of foundations until 31 December 2020.

Resolution of the Council of Ministers no. 89-A / 2020

Extract:

15- Determine that citizens cannot move outside the municipality of habitual residence in the period between 00:00 on October 30, 2020 and 06:00 on November 3, 2020, except for reasons of health or other reasons of imperative urgency.

16 – Determine that the restriction provided for in the preceding paragraph does not apply:

a) Health professionals and other workers of health and social support institutions, as well as teaching and non-teaching staff in schools;

b) Civil protection agents, security forces and services, military, militarized and civilian personnel of the Armed Forces and inspectors of the Food and Economic Security Authority;

c) Holders of political offices, magistrates and directors of the social partners and political parties represented in the Assembly of the Republic;

d) To ministers of worship, through accreditation by the competent bodies of the respective church or religious community, pursuant to paragraph 2 of article 15 of Law no. 16/2001 , of 22 June, in its current wording;

e) Support staff of sovereign bodies and parties with parliamentary representation, provided that the respective professional relationship is proven through a worker card or other suitable document;

f) Travel for the purpose of professional or similar activities, provided that:

i) Make a declaration, under honour, if the movement takes place between municipalities bordering the usual residence or in the same Metropolitan Area; or

ii) They are provided with a declaration from the employer, if the trip is not limited to the areas defined in the previous sub-paragraph.

g) Travel by minors and their companions to school establishments, day care centres and leisure activities, as well as travel by students to higher education institutions or other school establishments;

h) Travel by users and their companions to Occupational Activity Centers and Day Centers;

i) Travel to attend training and tests and examinations, as well as inspections;

j) Travel to participate in procedural acts with judicial entities or in acts within the competence of notaries, lawyers, solicitors, conservators and registry officers, as well as for assistance in public services, provided that they are provided with proof of the respective appointment;

k) Travel required to leave mainland Portugal;

l) Travel by non-resident citizens to places of proven residence;

m) Travel to attend cultural shows, if the travel takes place between municipalities bordering the usual residence or in the same Metropolitan Area and provided that they have the respective ticket;

n) Return to habitual residence.

17 – Determine that the restriction provided for in paragraph 15 does not prevent circulation between the portions of the municipalities in which there is territorial discontinuity.

18 – To determine that the provisions of paragraph 16 apply, with due adaptations, to the movement of non-resident citizens in mainland Portugal.

Council of Ministers Communiqué 14th October – Situation of Calamity effective 00.01 hrs 15th October 2020

1. The Council of Ministers approved on 14th October  a resolution declaring the situation of calamity throughout the national territory, in the context of the Covid-19 disease pandemic, until 11:59 pm on October 31, 2020.
The resolution also changes some rules and measures of the contingency state:
  • Limitation of gatherings to five people on public roads and other spaces of a commercial and catering nature, unless they are cohabiting;
  • Limitation on the number of people at family events (maximum 50 people);
  • Recommend the use of a community mask on the public road, whenever it is not possible to maintain the necessary social distance, as well as the use of the Stayaway Covid application and the communication of a positive test through it;
  • To determine the security forces and services and ASAE to monitor compliance with the rules;
  • Prohibit initiatives and activities of a non-academic nature in the academic space, such as parties, receptions for new students and practices;
  • In the Metropolitan Areas of Lisbon and Porto, the exceptional and transitional regime for reorganizing work applies to companies with workplaces with 50 or more workers;
  • Some rules on the opening hours of service areas and fuel stations are clarified.

 

2. A law proposal was approved, to be submitted to the Assembly of the Republic, which establishes the mandatory use of a community mask on public roads, whenever it is not possible to maintain the necessary social distance, as well as the use of the Stayaway Covid application, in the employment, academic, armed and security forces and public administration in general.

Resolution of the Council of Ministers no. 81/2020

Summary: Extends the declaration of the contingency situation in the context of the COVID-19 disease pandemic.

Taking into account the evolution of the COVID-19 disease pandemic in Portugal since the approval of the Resolution of the Council of Ministers no. 70-A / 2020 , of 11 September, which declared the contingency situation throughout the national territory, makes it is necessary to renew, for a period of 15 days, the contingency situation in Portugal.

Indeed, at the present time, the epidemiological situation in Portugal justifies the maintenance of the same rules and measures to combat the pandemic of the disease COVID-19, as the protection of public health and the safeguarding of the health and safety of the population , in order to mitigate the contagion and spread of the SARS-CoV-2 virus and the COVID-19 disease, remain fundamental. For this reason, this resolution only changes the period of validity of the contingency situation, remaining in force – and unchanged – all other rules and measures.

Resolution of the Council of Ministers no. 68-A / 2020

Summary: Extends the declaration of the contingency situation and alert, in the context of the COVID-19 disease pandemic.

Within the scope of the epidemiological situation caused by the new coronavirus SARS-CoV-2 and the disease COVID-19, as well as the measures that have been adopted in order to prevent, contain and mitigate the transmission of infection, the Government, through of this resolution, gives continuity to the process of deflation started on April 30, 2020.

In view of the evolution of the COVID-19 disease pandemic in Portugal, the need remains, for public health reasons, to declare the alert situation in most of Portugal and, in some territories, the contingency situation, under the terms of the Law of Civil Protection Bases, approved by Law No. 27/2006 , of July 3, in its current wording.

Thus – under articles 12 and 13 of Decree-Law no. 10-A / 2020 , of 13 March, in its current wording, and the law on the Public Health Surveillance System, approved by Law no. 81/2009 , of 21 August – the exceptional and specific measures applicable, namely to the activities of retail trade establishments, the provision of services, catering establishments and access to services and buildings, are renewed public, as well as other additional and exceptional measures that are essential, adequate and proportional to the interruption of the transmission chains of the disease COVID-19.

Council of Ministers Communiqué of 27 August 2020

1.The Council of Ministers approved today a resolution extending the declaration of the contingency situation in the Lisbon Metropolitan Area and the alert situation in the rest of the territory in the context of the Covid-19 disease pandemic until 23h59 on 14 September 2020.

 

2. The decree amending the exceptional and temporary measures concerning the Covid-19 disease pandemic was approved. The decree highlights the following:

It specifies that the protection of employees and self-employed workers under the general social security system, corresponding to 100% of the reference wage, up to a limit of 28 days, under the prophylactic isolation allowance or sickness benefit, with effect from 25 July;

Extends, until 31 March 2021, the period available to catering and beverage service providers to adapt to the provisions concerning the non-use and non-availability of single-use plastic tableware. A deadline of 31 December 2020 is set for clarifying and harmonising legislative provisions in this area in order to proceed with the first phase of transposition of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019;

The legal regime for package travel is adjusted, as the solution allowing the issue of a voucher of equal value to the payment made by the traveller or for rescheduling in the event of cancellation was exceptional;

Amends the decree-law establishing exceptional measures for the organisation and operation of educational and training activities, in the context of the pandemic, reinforcing the number of places in the general regime for access to higher education.

 

3,The decree-law updating the age of access to pensions and eliminating the sustainability factor in the special schemes for bringing forward the age of old-age pension has been approved.

 

4.The resolution of the Council of Ministers extending the Government’s support under the Economic Revitalisation Plan for Terceira Island was also approved. In order to respond to the effects of the pandemic which have made themselves particularly felt on Terceira Island, it is ensured that the instruments available for the development and recovery of Terceira Island continue to be mobilised, through measures enabling the qualification of the hotel offer, the development of differentiating tourist products, tourist training and the qualification of human resources, and the dynamisation and promotion of tourist operations.

 

5.The council approved the decree-law establishing the possibility of extending the fixed-term contracts celebrated with non-teaching staff of schools in the public network of the Ministry of Education, in the context of the Covid-19 disease pandemic, until the end of the 2020/2021 school year.

 

6. The decree-law defining the terms for the regularisation of the property assets of the Portuguese Institute for Quality (Instituto Português da Qualidade) was approved, as well as the procedures necessary for this purpose.

 

7. The resolution delegating to the Minister for the Environment and Climate Action (Ministro do Ambiente e da Ação Climática) the power to approve proposals for the delimitation of the public water, maritime and non-maritime domain was approved, with a view to a more prompt and effective conclusion of this type of administrative procedure.

 

8.The decree-law extending the transitional rule on access to the profession of technician for the installation and maintenance of buildings and systems, as well as the adoption of administrative simplification measures for the respective access, has been approved.

9. The decree-law regulating the exercise of commercial maritime fishing was approved, with a view to ensure the conservation and sustainable exploitation of biological resources, and establishing the legal framework applicable to the authorisation, registration and licensing of vessels or boats used in the professional activity of fishing, allowing gains in terms of speed and simplification of procedures and reducing administrative costs for economic agents.

 

1o. The decree law establishing the terms for the integration of workers assigned to regional operational programmes into the staff charts of the Regional Coordination and Development Commissions (CCDR) was approved in its final version, providing for their integration into the specific staff chart of the Agency for Development and Cohesion.

 

11. Finally, a resolution was adopted authorising the Social Security Institute to incur the expenditure involved in purchasing operational management services as a contact centre for social security, with a view to ensure that requests for information submitted by Member States are answered.

1. The Council of Ministers today approved the resolution extending the declaration of the contingency situation, in the Metropolitan Area of ​​Lisbon, and alert, in the rest of the territory, until 23:59 on August 31, 2020.
The resolution also provides for the following changes to the measures in force:
– the schedules of retail establishments and the provision of services in the areas covered by the declaration of contingency situation can now be adapted by the Mayor of the Territorially competent, with the favorable opinion of the local health authority and security forces;
– in the areas covered by the alert statement, retail outlets and service providers may open before 10 am;

2.The decree-law amending the exceptional and temporary measures related to the Covid-19 disease pandemic was approved, with emphasis on:
– the resumption of social support activities developed in Day Centers as of August 15, through an assessment of the conditions for reopening, to be carried out by the institution, the Social Security Institute and the local health authority, without prejudice to the maintenance of the suspension activities in the Lisbon Metropolitan Area;
– the possibility of using remote means of communication for the practice of acts in all urgent and non-urgent cases, which run under the terms of the peace judgments;
– the use of means of distance communication for the presentation of the birth certificate that occurred in national territory and its use is made possible in relation to births that occurred abroad, regarding the children of a Portuguese father or mother;
– the regime regarding the suspension of the Professional Internship Program in Local Administration (PEPAL) is adjusted, allowing the promoters to resume the signing of new contracts and ending the suspension of all deadlines related to the respective procedures.
3. The Council of Ministers clarified the measure related to the stabilization complement provided for in the Economic and Social Stabilization Program (PEES).
Created with the aim of providing extraordinary support to workers who have had a reduction in income as a result of the pandemic, the stabilization supplement is thus now awarded to workers whose base pay in February 2020 has been equal to or less than twice RMMG and that, between the months of April and June, have been covered for at least 30 days followed by support for the maintenance of the employment contract, provided for in Decree-Law no. 10-G / 2020, of 26 March, or for temporary reduction of the normal working period or suspension of the employment contract, pursuant to articles 298 and following of the Labour Code.

1. The Council of Ministers today approved, electronically, the resolution that gives continuity to the process of deflation started on April 30, 2020, maintaining the declaration of the situation of alert, contingency and calamity, depending on the territory.
It is declared, from 00:00 on July 15, 2020 and until 23:59 on July 31, 2020, the maintenance of the current regime regarding the declaration of the situation of alertness, contingency and calamity. That is:
– the alert situation in the entire continental national territory, with the exception of the Metropolitan Area of ​​Lisbon (AML);
– the contingency situation in the AML, with the exception of the municipalities and parishes affected by the calamity situation;
– the calamity situation in the same 19 parishes in the Lisbon Metropolitan Area.
This decision takes into account that, although there is a decreasing trend in the number of new cases of disease in most regions of the national territory, there is a persistent incidence in some areas of the Regional Health Administration of Lisbon and Vale do Tejo, specifically in the North of the Metropolitan Area of ​​Lisbon.
All the rules and recommendations currently in force are maintained, introducing the following determinations:
– it is clarified that amusement and similar equipment (carousels) are allowed (except in the AML), subject to certain rules, and amusement parks and recreational and similar parks for children are closed throughout the country. and dance or party halls;
– it is specified that the final of the Portuguese Cup and the final phase of the Champions League are held without an audience;
– rules on air traffic and airports are clarified, namely: the obligation for passengers on flights originating in countries considered to be at epidemiological risk at present, at the time of departure, proof of conducting a test for screening for SARS infection- CoV-2 with negative result, carried out in the 72 hours prior to the moment of embarkation; and the obligation for ANA – Aeroportos de Portugal to carry out, at the Portuguese international airports that it manages, infrared body temperature screening for all passengers arriving in Portugal and to implement the respective protection and containment measures. These rules are not applicable to airports in the Autonomous Regions of Madeira and the Azores.
2. The decree-law amending the exceptional and temporary measures relating to the pandemic of Covid-19 disease was approved, with emphasis on:
– the maintenance, until 31 July 2020, of the food support provided by groups of schools and non-grouped schools in the public school system for students benefiting from levels A and B of school social action;
– the extension, until 31 December 2020, of the allocation of financing and compensation to public passenger transport operators, promoting the sustainability of those companies, whose activity and revenues were strongly affected by the measures to limit the circulation of collective means of transport adopted in the context of the pandemic situation;
– for the purpose of the maximum duration of the research grants provided for in the Research Fellowship Statute, it is safeguarded that the periods elapsed during the suspension of on-site activities in higher education institutions are not counted, as well as the suspension periods determined by national or foreign public authority and that apply to grant recipients.
3. The decree-law that changes the sanctioning regime applicable to the non-compliance with the duties established by declaring the situation of alert, contingency or calamity was approved.
The statute adds to the duties of natural and legal persons compliance with the rules applicable to air traffic and airports, under the terms of the declarations of the respective alert, contingency or calamity situations. It is established that, in the case of non-compliance with the air traffic rules and the airports by the airlines or by the entities responsible for the management of the respective airports, it constitutes an infraction sanctioned with a fine of: € 500 to € 2000, for each passenger boarding without demonstrate a negative Covid-19 laboratory test, or waiver of your need; and € 2000 to € 3000, for failure to comply with the obligation to track infrared body temperature to all passengers arriving in Portugal.
Compliance with the obligation is monitored by ANAC and SEF.

Communiqué of the Council of Ministers of 25 June 2020

1..The Council of Ministers approved today the resolution that continues the process of de-confinement initiated on April 30, declaring the situation of alert, contingency and calamity, depending on the territory, with effect from 00:00h on July 1 and until 23:59h on July 14, 2020.

The calamity situation covers 19 parishes in the municipalities of Amadora, Odivelas, Loures, Sintra and Lisbon: in Amadora – Alfragide, Águas Livres, Falagueira-Venda Nova, Encosta do Sol, Venteira, Mina de Água; in Odivelas – União de Freguesias da Pontinha e Famões, União de Freguesias Póvoa de Santo Adrião e Olival Basto, Ramada/Caneças e Odivelas; in Loures – União das Freguesias de Camarate, Unhos e Apelação and in União das Freguesias de Sacavém e Prior Velho; in Sintra – Union of the parishes of Agualva and Mira Sintra, in the parish of Algueirão – Mem Martins, in the Union of the parishes of Cacém and São Marcos, in the Union of the parishes of Massamá and Monte Abraão, in the Union of the parishes of Queluz and Belas and in the parish of Rio de Mouro; and Santa Clara, in Lisbon.

The alert situation is declared throughout the national mainland, with the exception of the Lisbon Metropolitan Area, where the contingency situation applies, and the municipalities and parishes that remain in a calamity situation.

For reasons of public health, the need for compliance with rules of occupation, permanence and physical distance, as well as hygiene rules, is maintained; and exceptional and specific measures are renewed with regard to activities relating to retail establishments, the provision of services and catering establishments.

For concentrations of persons, a limit of 20, 10, or 5 persons is established, depending on whether the situation declared on the spot is one of alert, contingency or calamity, respectively.

In the Lisbon Metropolitan Area (AML) the rule remains that all retail and service establishments, as well as those in commercial complexes, close at 20h00, except supermarkets, which may close at 22h00 and are not allowed to sell alcoholic beverages after 20h00.

In the parishes affected by the disaster, there is a civic duty of home collection, except for a number of activities, namely for the purpose and performance of professional activities.

The prohibition, which had already been established for AML, of the consumption of alcoholic beverages in open air spaces with public access and public roads is extended to the whole territory, except for the outdoor spaces of catering establishments and beverages duly licensed for that purpose.

It is clarified that events of a cultural nature are not considered to be concentrations of people for the purposes of this regime provided that they comply with certain rules. Bullfighting arenas and facilities, spas and hot springs are no longer closed.

 

2.  The Decree-Law establishing the administrative offence regime applicable to failure to comply with the duties established by declaration of the alert, contingency or calamity situation was approved.

The sanctions now established apply to situations of violation of the rules of occupation, permanence and physical distancing, rules relating to the use of masks or visors, rules relating to the suspension of the operation of certain establishments that must remain closed, rules relating to the opening hours of retail or service establishments, or rules relating to the maximum capacity of transport.

Fines from EUR 100.00 to EUR 500.00 are possible in the case of individuals, and from EUR 1000.00 to EUR 5000.00 in the case of corporations.

The inspection is the responsibility of the National Republican Guard (GNR), the Public Security Police (PSP), the Maritime Police (Polícia Marítima), the Authority for Economic and Food Safety (ASAE) and the Municipal Police.

 

3. The Healthy Neighbourhoods Programme was created at a national level as a national initiative that promotes health, social, economic, environmental and urban projects among the local communities most affected by the pandemic, or by other factors that affect their health and well-being conditions.

This Programme is intended to be a public policy instrument aimed at fostering partnerships and local interventions to promote the health and quality of life of territorial communities, through support for projects submitted by associations, collectivities, non-governmental organisations, civic movements and residents’ organisations, in collaboration with municipalities and health authorities.

 

4. The draft law, to be submitted to the Assembly of the Republic for consideration, was approved, modifying the exceptional regime for situations of delay in the payment of the rent due under the terms of urban housing and non-residential lease agreements, in the context of the COVID-19 pandemic.

The legislative intention is to modify the regime foreseen in the legislation for non-housing leases in order to extend the rents that may be deferred, to establish new rules for their deferred payment and to provide for a mechanism that facilitates the agreement between landlord and tenant for the settlement of unpaid rents.

In the name of the financial sustainability of many commercial operators, a new balance is being sought which, while respecting the essence of the private property rights of landlords, will allow the economic recovery of the establishments.

Special measures applicable to the Lisbon Metropolitan Area

6 – In the Metropolitan Area of ​​Lisbon, the consumption of alcoholic beverages in open spaces accessible to the public is prohibited, except for the outside spaces of the catering and beverage establishments duly licensed for the purpose and in accordance with the limitation established in no. 2.

7 – The operational activity of security forces and services and rescue services operating in the Metropolitan Area of ​​Lisbon, within the scope of the implementation of the present regime, may be reinforced, if necessary, by personnel from other geographical areas, in articulation with the municipal civil protection structure. »

4 – To determine that the publication of this resolution constitutes sufficient communication for all legal purposes, namely for the fulfillment of the type of crime of disobedience.

5 – To determine that the present resolution takes effect at 00:00 on 23 June 2020.

 

SITUATION OF CALAMITY

3. The Council of Ministers decided to extend the declaration of a situation of calamity until 23:59 on June 28, continuing the process of de-confinement underway.

There is still the need to comply with rules of occupation, permanence and physical distance, as well as rules of hygiene, and also to maintain in force exceptional and specific measures regarding activities relating to retail establishments, service provision, catering establishments and access to services and public buildings.

The main changes (applicable from 15 June) in relation to the third phase of de-confinement are as follows:

  • The special limitations that were foreseen for the Lisbon Metropolitan Area will no longer apply, but the general rules in force for the rest of the country will – concentrations of up to 20 people (the limit was 10 people) will be permitted; establishments with an area of more than 400m2 or inserted in shopping centres and the respective food and drink consumption areas will no longer have their activity suspended;
  • Water parks, language schools and tutoring centres will be opened;
  • The rule of limiting the number of occupants in private vehicles with a capacity of more than five seats is extended to the whole territory, unless all occupants are in the same household, due to the difficulty of social distancing in motor vehicles, especially in the transport of workers;
  • It continues to be stipulated as a rule that establishments that have resumed or are resuming their activity may not open before 10 a.m., but exception is made, in addition to the situations already exempted, to gyms and health clubs (allowing them to open before 10 a.m.);
  • It is determined that activities and spaces that remain closed may open when they have specific guidance from the Directorate General of Health regarding their operation.

5. The resolution that extends the restoration, on an exceptional and temporary basis, of the control of persons at the border with Spain, until 11:59 pm on 30 June 2020, in the context of the COVID-19 disease pandemic, was approved, without prejudice to re-evaluation every 10 days and possible extension.
