Transitional imposition of the mandatory use of a mask in public spaces

The Assembly of the Republic decrees, under the terms of paragraph c) of article 161 of the Constitution, the following:

Article 1

Objective

This law, exceptionally, requires the use of a mask for access, circulation or permanence in public spaces and roads.

Article 2

Territorial scope

This law applies throughout the national territory.

Article 3

Use of mask

1 – The use of a mask by persons aged 10 and over is mandatory for access, circulation or permanence in public spaces and roads whenever the physical distance recommended by health authorities proves impractical.

2 – The obligation referred to in the previous number is waived:

a) Upon presentation:

i) Medical certificate of multiple disability or medical declaration, in the case of people with cognitive impairment, development and psychological disorders;

ii) A medical statement attesting that the person’s clinical condition is not consistent with the use of masks;

b) When the use of a mask is incompatible with the nature of the activities that people are carrying out;

c) In relation to people who are part of the same household, when they are not in the proximity of third parties.

Article 4

Awareness campaign for the use of a mask

Awareness campaigns are carried out, in the media and among the population, on the importance of wearing a mask in public spaces and roads, to guarantee the spontaneous adherence of the population to this and other measures of individual and collective protection, as well as to encourage the use of reusable masks and the correct disposal of non-reusable masks.

Article 5

Oversight

The enforcement of the obligations provided for in this law is the responsibility of the security forces and the municipal police, with priority being given to raising awareness and teaching about the importance of wearing a mask in public spaces and roads when it is not possible to maintain social distance.

Article 6

Administrative Offence

Failure to comply with the obligation established in article 3 constitutes an offense under the terms provided for in article 3 of Decree-Law no. 28-B / 2020 , of 26 June, in its current wording.

Article 7

Subsidiary law

In everything that is not provided in the this law, the administrative regime provided for in Decree-Law no. 28-B / 2020 , of June 26, and the general regime of mere social order, constant of Decree-Law No. 433/82 , of October 27, in its current wording.

Article 8

Application in autonomous regions

The provisions of this law apply to the Autonomous Regions of the Azores and Madeira, with the necessary adaptations, taking into account regional specificities, by decree of the respective regional government.

Article 9

Validity

This law is in force for a period of 70 days from the date of its entry into force, and is assessed, regarding the need for its renewal, at the end of that period.

Article 10

Implementation

This law enters into force on the day following its publication.
