1 – Who, of repeated or no way, inflicting physical or mental ill-treatment, including corporal punishment, deprivation of liberty and sexual offences:
a) the spouse or former spouse;

2 – In the case of the preceding paragraph, if the agent commits the act against a minor, the presence of smaller, the common home or in the victim’s home is punishable with imprisonment from two to five years.
3 – If the facts set out in paragraph 1 result:
a) Offence to serious physical integrity, the offender shall be punished with imprisonment of two to eight years;
b) The death, the offender shall be punished with imprisonment of three to ten years.
