Resolution of the Council of Ministers no. 96-B / 2020
Summary: Extends the declaration of the calamity situation, in the context of the COVID-19 disease pandemic.
Through Resolution of the Council of Ministers no. 88-A / 2020 , of October 14, and, subsequently, Resolution of the Council of Ministers no. 92-A / 2020 , of November 2, the situation of calamity throughout the continental national territory.
The epidemiological situation in Portugal and the deadline contained in Decree no. 8/2020 , of 8 November, justifies the extension of the calamity situation in order to align with the period of application of the state of emergency.
However, in addition to the renewal of the calamity situation, two amendments are still made to this resolution.
First, the list of municipalities that appear in the annex to the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November , is changed , and to which, consequently, special rules apply. Indeed, based on the epidemiological criteria established by that resolution, some municipalities are removed and other municipalities are added.
The municipalities of Batalha, Mesão Frio, Moimenta da Beira, Pinhel, São João da Pesqueira, Tabuaço and Tondela are removed from that annex – with effects concomitant to the entry into force of the resolution now approved.
Conversely, they are added to annex ii to the Resolution of the Council of Ministers no. 92-A / 2020, from 2 November, the following municipalities: Abrantes, Águeda, Albergaria-a-Velha, Albufeira, Alcanena, Aljustrel, Almeida, Almeirim, Alvaiázere, Anadia, Ansião, Arcos de Valdevez, Arganil, Arronches, Boticas, Campo Maior, Cantanhede , Carrazeda de Ansiães, Castro Daire, Celorico da Beira, Coimbra, Condeixa-a-Nova, Coruche, Crato, Cuba, Elvas, Estarreja, Évora, Faro, Ferreira do Alentejo, Figueira de Castelo Rodrigo, Freixo de Espada à Cinta, Grândola , Ílhavo, Lagos, Lamego, Mangualde, Manteigas, Mealhada, Mêda, Mira, Miranda do Corvo, Miranda do Douro, Mirandela, Monforte, Montalegre, Montemor-o-Velho, Mora, Murtosa, Nelas, Oliveira do Bairro, Ourém, Pampilhosa da Serra, Penalva do Castelo, Penamacor, Penela, Ponte de Sor, Portalegre, Portimão, Proença-a-Nova, Reguengos de Monsaraz, Resende, Salvaterra de Magos, São Pedro do Sul, Sátão, Seia,Sousel, Tábua, Tavira, Torre de Moncorvo, Vagos, Vieira do Minho, Vila do Bispo, Vila Nova de Foz Côa, Vila Nova de Paiva, Vila Real de Santo António and Viseu.
However, regarding the effects of adding these municipalities, it will only take effect at 00:00 on 16 November 2020, in order to guarantee time for adaptation to the new measures. In this way, all special restrictions defined for high-risk counties will only apply to those counties as of that date.
On the other hand, new rules are also created applicable to the municipalities listed in annex ii to the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November. These rules refer essentially to the operation of certain establishments outside the period between 08:00 and 13:00 on Saturdays and Sundays.
In particular, it is determined that, outside the period between 8:00 am and 1:00 pm on Saturdays and Sundays, activities in retail outlets and the provision of services are suspended, except those that are excluded from this measure, such as pharmacies, clinics and offices, or retail outlets for food products, as well as natural or dietary, health and hygiene, with a sales or service area of 200 square meters or less with autonomous and independent entry from the public road. In addition, catering establishments and the like will only be able to operate for home delivery after 13:00 on Saturday and Sunday.

Under the terms of articles 12 and 13 of Decree-Law no. 10-A / 2020 , of 13 March, in its current wording, pursuant to the provisions of article 2 of Law no. 1- A / 2020 , of 19 March, in its current wording, of article 17 of Law no. 81/2009 , of 21 August, of no. 6 of article 8 and of article 16 of Law no. 27/2006 , of July 3, in its current wording, and in paragraph g) of article 199 of the Constitution, the Council of Ministers resolves:
1 – Amend paragraph 1 of the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November, which is replaced by the following:
«1 – To declare, following the epidemiological situation of COVID-19, until 11:59 pm on November 23, 2020, the calamity situation in the entire continental national territory.»
2 – Add article 29 to the regime attached to the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November, with the following wording:
“Article 29
Suspension of activities in the municipalities referred to in Annex II
1 – In the municipalities referred to in annex ii to this regime, on Saturdays and Sundays, outside the period between 8:00 am and 1:00 pm, activities in retail and service establishments are suspended.
2 – Except for the provisions of the previous number:
a) Retail establishments of food products, as well as natural or dietary, health and hygiene, with a sales or service area equal to or less than 200 square meters with autonomous and independent entry from the road public;
b) Catering establishments and similar establishments, regardless of the area of sale or provision of services, provided that they are exclusively for home delivery purposes;
c) Pharmacies;
d) Funeral and related activities;
e) Medical services or other health and social support services, namely offices and clinics, dental clinics and emergency medical-veterinary centers;
f) Service areas and fuel stations that integrate highways, cafeteria and restaurant activities are not allowed;
g) Fuel filling stations not covered by the preceding paragraph, exclusively for the purpose of selling fuels and supplying vehicles to the public and provided that within the scope of travel authorized under article 3 of Decree no. 8/2020, of November 8;
h) The establishments providing services for the rental of goods vehicles without drivers (rent-a-cargo) and the rental of passenger vehicles without drivers (rent-a-car);
i) Establishments providing accommodation services;
j) Establishments located inside airports located in mainland Portugal, after checking the security of passengers.
3 – Without prejudice to the provisions of paragraph 3 of article 10, establishments whose opening hours are earlier than 08:00 am may continue to practice their usual opening hours.
4 – For the purposes of the provisions of the preceding paragraph, the usual opening hours are those that have been communicated to the municipality with territorial authority until the entry into force of Decree No. 8/2020 , of 8 November.
5 – In the case of establishments authorized to operate 24 hours a day, they are authorized to reopen after 8:00 am.
6 – This article is a special rule and prevails over the other provisions of the present regime that provide otherwise.
3 – Amend annex ii to the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November, as amended by annex i to this resolution and which is an integral part thereof, with effect from 00:00 h on November 13, 2020.
4 – Amend annex ii to the Resolution of the Council of Ministers no. 92-A / 2020 , of 2 November, as amended by annex ii to this resolution and which is an integral part thereof, with effect from 00:00 h on November 16, 2020.
5 – To determine that the present resolution takes effect at 00:00 on 13 November, without prejudice to the provisions of the previous number.
