Decree no. 3-E / 2021

Summary: Regulates the state of emergency decreed by the President of the Republic.
The epidemiological situation in Portugal – despite the reduction that has been occurring with regard to the number of new daily cases of contamination of the disease COVID-19, as well as its rate of transmission, as a result of the measures that have been be adopted -, justifies the renewal of the state of emergency, taking into account the still high levels of incidence of that disease and the number of hospitalizations and deaths.
It is therefore not recommended to reduce the measures that have been adopted. It is essential that the trend of decreasing the number of daily contagions is maintained, and, for this purpose, it is necessary that the rules that have been applicable continue to be in force.
Thus, this decree extends Decree no. 3-A / 2021 , of January 14, in its current wording, and Decree no. 3-D / 2021 , of January 29, determining the continued applicability, in the next fortnight, of the rules that those diplomas establish.
Regarding the limitations that may be applied to retail establishments that sell various types of goods, it is prohibited that those limitations relate to books and school supplies.

Under the terms of paragraph g) of article 199 of the Constitution, the Government decrees:
Article 1
Object
This decree regulates the extension of the state of emergency effected by the Decree of the President of the Republic no. 11-A / 2021 , of 11 February.
Article 2
Extension of Decree no. 3-A / 2021 , of January 14
Decree No. 3-A / 2021 , of January 14, in its current wording, is extended until 23:59 on March 1, 2021.
Article 3
Extension of Decree No. 3-D / 2021 , of 29 January
Without prejudice to the provisions of articles 5 and 6 of this decree, the term of Decree no. 3-D / 2021 , of January 29, in the language given by this decree, is extended until 11:59 pm of March 1, 2021.
Article 4
Amendment to Decree no. 3-A / 2021 , of 14 January
Article 25 of Decree no. 3-A / 2021 , of 14 January, is replaced by the following:
“Article 25

1 – The member of the Government responsible for the area of ​​the economy may, by means of an order, determine that retail trade establishments that market more than one type of goods and whose activity is permitted under the scope of this decree may not market goods typically traded in retail establishments closed or with activity suspended under the terms of this decree, with the exclusion of books and school materials, which must remain available to students and citizens in general.

Amendment to Decree no. 3-D / 2021 , of 29 January
Article 3 of Decree 3-D / 2021 , of 29 January, is replaced by the following:

Article 6
Repealing rule
The following are repealed:
a) Article 27 and paragraph a) of no. 1 and no. 2 of article 31-A of Decree no. 3-A / 2021, of 14 January, in its current wording ;
b) Paragraph 1 of article 3 of Decree no. 3-D / 2021, of 29 January.

Implementation
This decree comes into force at 00:00 on February 15, 2021.
