Decree No. 5/2021 of March 28
Summary: Regulates the state of emergency decreed by the President of the Republic.
Notwithstanding its positive evolution, the epidemiological situation – as well as the gradual strategy for lifting measures provided for in the Resolution of the Council of Ministers no. 19/2021 , of 13 March – justifies the renewal of the state of emergency, which happened through the Decree of the President of the Republic no. 31-A / 2021 , of 25 March.
Considering, on the one hand, the aforementioned strategy of lifting containment measures, and, on the other hand, that the Easter period is approaching, the effectiveness of Decree no. 4/2021 , of 13 March, in its current wording , should be extended until next April 5, 2021.
Indeed, it is essential to seek to maintain the positive evolution of the epidemiological situation in order to be able to maintain the strategy established for the lifting of the containment measures.
It is also essential that, this year, the geographical movements and family gatherings that are typical of the Easter period are reduced.
Thus, this Decree extends the term of Decree No. 4/2021 , of 13 March, in its current wording. In essence, the rules therein remain in effect, making it clear, however, that the ban on movement outside the municipality of the home applies, daily, until 11:59 pm on April 5, without prejudice to exceptions provided for in the Decree.
It is also foreseen that the Government member responsible for the health area determines the strictly indispensable measures related to the processing of personal data by the health services and by the municipal or parish services, within the scope of the operations necessary for the execution of the vaccination plan against COVID -19, namely for the purpose of making contacts for vaccination.
So:
Under the terms of paragraph g) of article 199 of the Constitution, the Government decrees:

Article 1
Object
This decree:
a) Regulates the renewal of the state of emergency effected by the Decree of the President of the Republic no. 31-A / 2021, of 25 March;
b) Proceed with the first amendment to Decree No. 4/2021, of 13 March.

Article 2
Extension of Decree no. 4/2021 , of 13 March
The term of Decree 4/2021 , of 13 March, as amended by this decree, is extended until 11:59 pm on April 5, 2021.

Article 3
Amendment to Decree No. 4/2021 , of 13 March
Articles 5 and 12 of Decree No. 4/2021 , of 13 March, are replaced by the following:

It is forbidden to travel outside the municipality of the domicile in the period between 8:00 pm on Friday and 5:00 am on Monday and, daily, between 00:00 am on March 26 and 11:59 pm on April 5, without prejudice to the exceptions provided for in article 11 of Decree No. 9/2020 , of November 21, which are applicable with the necessary adaptations.

Implementation
