Summary: Approves the lists of countries to which the rules on air traffic, airports and land, sea and river borders apply and establishes the requirements for the validity of vaccination or recovery certificates issued by third countries, under reciprocal conditions.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus, the Resolution of the Council of Ministers No. 157/2021, of 27 November, declares the situation of calamity throughout the continental national territory, as of 1 December , providing for the rules applicable to air traffic, airports and land, sea and river borders. Article 18 of the regime attached to the aforementioned Resolution of the Council of Ministers establishes that, when the epidemiological situation so justifies, the members of the Government responsible for the areas of foreign affairs, national defense, internal administration, health and aviation civil authorities may, by order, determine the application of measures restricting entry into national territory and air traffic from certain countries,

Simultaneously, article 23 of the same regime annexed to the aforementioned Resolution of the Council of Ministers establishes, until January 9, 2022, special rules on testing applicable to international flights, under which it is now required, to all that enter mainland Portugal through the air border, the presentation of the EU COVID Digital Certificate in the modalities of test or recovery certificate, provided for in subparagraphs b) and c) of paragraph 1 of article 4 of Decree-Law no. 54-A/2021, of June 25, in its current wording, or alternatively, the presentation of proof of laboratory performance of the nucleic acid amplification test (TAAN) or rapid antigen test (TRAg) for screening the SARS-CoV-2 infection with negative result, performed within 72 or 48 hours prior to the respective time of departure.

In turn, pursuant to paragraph 2 of article 5 of Decree-Law no. 54-A/2021, of 25 June, in its current wording, the aforementioned members of the Government may also, for effects provided for in section ii of chapter ii of the aforementioned legal diploma, relating to the use of the EU COVID Digital Certificate, to recognize, by order, the validity of vaccination certificates issued by third countries, under reciprocal conditions, without prejudice to travelers provided of an EU COVID Digital Certificate or travelers holding a digital certificate that has been the subject of an implementing decision by the European Commission under Article 8(2) of Parliament Regulation (EU) 2021/953 European and Council, of 14 June 2021, may undertake non-essential travel, regardless of origin.

Finally, given the emergence of the new variant of the SARS-CoV-2 virus, designated Omicron and already classified as a variant of concern by the World Health Organization, and the measures already taken to prevent its spread should be maintained, it is extended the validity of Order No. 11740-E/2021, of 26 November, which determines the suspension of commercial or private flights to and from southern African countries, namely South Africa, Botswana, Essuatini, Lesotho, Mozambique, Namibia and Zimbabwe, as well as the imposition of testing and compliance with prophylactic isolation for all citizens who come from these countries.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B/2019, of December 3, in its current wording, of paragraph 2 of article 5 of Decree-Law no. 54-A/2021, of June 25, and articles 18. , 20th and 22nd of the regime annexed to the Resolution of the Council of Ministers No. 157/2021, of 27 November, the Minister of National Defence, the Minister of Internal Administration, the Minister of Health, the Minister of Infrastructure and Housing and the Secretary of State for European Affairs determine:

1 – Approve, in Annex I to this Order, of which it forms an integral part, the list of countries, special administrative regions and territorial entities and authorities not recognized as countries by at least one Member State of the European Union, whose epidemiological situation complies with Council Recommendation (EU) 2020/912 of 30 June 2020, and respective updates, whose air traffic to and from mainland Portugal is authorized for non-essential travel purposes, subject to confirmation by reciprocity.

2 – Allow non-essential travel to Brazil, the United States of America and the United Kingdom.

3 – Recognize, for the purposes set out in section ii of chapter ii of Decree-Law No. 54-A/2021, of 25 June, the validity of vaccination or recovery certificates issued by third countries, under reciprocal conditions, when these form part of the data fields listed in Annex II to this Order, of which it forms an integral part.

4 – Non-reciprocity in the recognition by third countries of the validity of the EU COVID Digital Certificate, in the modalities of vaccination or recovery certificates, issued by Portugal, prevents recognition of the validity of certificates issued by these third countries.

5 – For the purposes of the provisions of paragraphs 3 and 4, the validity of vaccination certificates issued within the scope of this Order will only be recognized if their holders have been inoculated with vaccine against COVID-19 with authorization to market in the terms of Regulation (EC) No. 726/2004, contained in annex iii to this order, of which it forms an integral part.

6 – Without prejudice to the recognition of vaccination or recovery certificates issued by third countries, pursuant to paragraphs 3 to 5, during the period of validity of this order, the special rules on testing provided for in article 23 shall apply of the Resolution of the Council of Ministers No. 157/2021, of 27 November.

7 – Order No. 11740-E / 2021, of 26 November, (below) is extended.

8 – This order takes effect from 00:00 on December 1, 2021 and until 23:59 on January 9, 2022, and may be revised at any time, depending on the evolution of the epidemiological situation.

f) Marketing authorization holder or manufacturer of the vaccine against COVID-19;

g) Number in a series of doses, as well as the total number of doses in the series;

h) Date of vaccination, indicating the date of the last dose administered;

i) Member State or third country where the vaccine was administered;

j) Entity issuing the certificate.

2 – Recovery certificates must include at least the following information:

a) Name(s) and surname(s) of the holder;

b) Date of birth;

Summary: Determines the suspension of air traffic to Mozambique and determines compliance with prophylactic isolation of passengers from some southern African countries.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus, namely the emergence of the new variant B.1.1.529, called Omicron and currently classified as a variant of concern by the World Health Organization, it is imperative to adopt restrictive measures for in order to prevent its dissemination, in line with the Operational Conclusions of the Integrated Policy Response Mechanism to crisis situations, of 26 November.

Among the guidelines resulting from this meeting, the recommendation to activate the safeguard clause, contained in Recommendation (EU) 2020/912 of the Council, of June 30, 2020, in its current version, which establishes that in cases where the The epidemiological situation rapidly deteriorates and, in particular, if a high incidence of worrying variants of the virus is detected, restrictions on non-essential travel to and from third countries can be rapidly reintroduced.

Given the rapid increase in the incidence of this variant in South Africa, it is recommended that commercial or private flights to and from southern African countries be suspended, namely South Africa, Botswana, Essuatini, Lesotho, Mozambique, Namibia and Zimbabwe, as well as the imposition of testing and compliance with prophylactic isolation to all citizens who come from these countries. Considering that Portugal only carries out direct flights to and from Mozambique, it is justified that, under the aforementioned terms, all passengers on flights, regardless of origin, who present a passport with departure registration from the other countries mentioned, are subject to prophylactic isolation, in the 14 days prior to your arrival in mainland Portugal.

The Resolution of the Council of Ministers No. 135-A/2021, of September 29, in its current wording, declares the alert situation throughout the continental national territory, providing for the rules applicable to air traffic, airports and borders land, sea and river.

Article 14 of the regime attached to the Resolution of the Council of Ministers determines that when the epidemiological situation so justifies, the members of the Government responsible for the areas of foreign affairs, national defense, internal administration, health and civil aviation may , by order, to determine the application of restrictive measures to entry into national territory and to air traffic from certain countries.

The same regime also establishes, in article 16, the possibility of determining that passengers on flights originating in countries considered at risk within the scope of the pandemic situation caused by COVID-19, must comply, after entering Portugal continental, a period of prophylactic isolation of 14 days, at home or in a place indicated by health authorities.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B/2019, of December 3, in its current wording, and articles 14 and 16 of the regime attached to the Resolution of the Council of Ministers No. 135-A/2021, of September 29, in in its current wording, the Minister of National Defence, the Minister of Internal Administration, the Minister of Health, the Minister of Infrastructure and Housing and the Secretary of State for European Affairs determine:

1 – The suspension of flights to and from countries included in the list contained in the annex to this order, of which it is an integral part.

2 – Authorize flights to support the return of national citizens or holders of residence permits in Portugal, as well as humanitarian flights, which have been recognized by the competent services of the governing area of foreign affairs and by the competent authorities in matters of civil aviation, and flights intended to allow foreign citizens who are in Portugal to return to their respective countries, provided that such flights are promoted by the competent authorities of such countries, subject to prior request and agreement, and in compliance with the principle of reciprocity.

3 – To determine that passengers on flights originating in Mozambique and those who, regardless of origin, present a passport with a departure record from the countries referred to in the list attached to this order, of which it is an integral part, in the 14 days prior to their arrival in Mainland Portugal, must comply, after entering Mainland Portugal, a period of prophylactic isolation of 14 days, at home or in a place indicated by the health authorities.

4 – The passengers referred to in the previous number will be sent, upon arrival in mainland Portugal, to a proper location inside the airport for the purpose of carrying out the nucleic acid amplification test (TAAN) or rapid antigen test (TRAg ), for screening for SARS-CoV-2 infection and subsequent genomic sequencing, as well as for determination of prophylactic isolation by health authorities.

5 – The provisions of the preceding paragraphs are also applicable, with the necessary adaptations, to citizens who enter national territory by sea or land.

6 – Passengers on flights from Mozambique are subject to prophylactic isolation pursuant to paragraph 3 until the date of effect of the present order referred to in the following paragraph.

7 – This order takes effect from 00:00 on November 27, 2021, with the exception of the suspension of flights provided for in paragraph 1, which takes effect from 00:00 on November 29, 2021.

In addition, under the terms of paragraph 2 of article 5 of Decree-Law no. 54-A/2021, of 25 June, the said members of the Government may also, for the purposes set out in section ii of the chapter ii of the aforementioned legal diploma, regarding the use of the EU COVID Digital Certificate in matters of air and maritime traffic, to recognize, by order, the validity of vaccination or recovery certificates issued by third countries, under reciprocal conditions, without prejudice to the travellers holding an EU COVID Digital Certificate or travellers holding a digital certificate that has been the subject of an implementing decision of the European Commission pursuant to Article 8(2) of Regulation (EU) 2021/953 , of the European Parliament and of the Council, of June 14, 2021, to be able to make non-essential trips, regardless of origin.

Digital Vaccination certificates
 
Read in conjunction with Decree Law 54-A/2021 dated 25th June 2021  concerning EU Digital Certificates (for travel) which can be download in informal English here with link to original Portuguese version
 
 
On 16th June 2021 Portugal began issuing digital vaccination certificates against covid-19 and, as of 17th June Thursday, it will be possible to request test certificates on the SNS24 portal, in addition to this one PCR and recovery, announced the authorities.
 
In a joint statement, the Ministry of Health, the General Directorate of Health (DGS) and the Shared Services of the Ministry of Health explain that, to obtain the digital certificate, the citizen must access the NHS 24 portal, follow the instructions and choose the type of certificate you want.
 
After validation of the order, the document is made available on the portal or can be sent later to the ’email’ indicated, without any associated costs.
 
The Directorate-General for Health published today a guideline that aims to respond to the European Parliament’s call to facilitate the movement of citizens in the European Union during the COVID-19 pandemic, through the issuance of the EU COVID Digital Certificate for vaccination, testing and recovery of COVID-19 as of July 1, 2021.
 
To that end, the European Regulation recommends that Member States refrain from imposing additional travel restrictions, such as tests or quarantines, on citizens holding a valid EU COVID Digital Certificate, unless they are proportionate and necessary to safeguard public health .
 
In accordance with DGS guidance, the EU COVID Digital Certificate will be free and issued in Portuguese and English, and may, at this stage, be requested by national and foreign citizens, residing in Portugal and who are holders of the User Number of the National Health Service.

The resumption of air routes with the countries of the European Union, as well as in the Schengen Area, is dependent on border restrictions and on the evolution of the epidemiological situation worldwide. Therefore, before making a trip, it is important to consult the alerts and restrictions provided by foreign and border services, whether in the country where the trip starts as in Portugal (www.sef.pt), as well as checking the necessary procedures and documents with the airline .

Summary: Approves the lists of countries and international sporting competitions to which the rules on air traffic, airports, land, sea and river borders apply.

In the context of the epidemiological situation caused by the SARS-CoV-2 virus and the exceptional measures adopted to deal with the disease COVID-19, the Resolution of the Council of Ministers No. 114-A/2021, of 20 August, declares the situation of contingency throughout the continental national territory, providing for the rules applicable to air traffic, airports and land, sea and river borders.

In articles 27, 29 and 31 of the regime attached to the aforementioned resolution of the Council of Ministers, it is established that the members of the Government responsible for the areas of foreign affairs, national defence, internal administration, health and of civil aviation may, by order, allow non-essential travel to or from specific countries when the epidemiological situation so justifies, and define the list of countries for which the mandatory confinement of citizens entering national territory from a countries, special administrative regions and territorial entities and authorities not recognized as countries by at least one Member State, whose epidemiological situation is in accordance with Council Recommendation (EU) 2020/912 of 30 June 2020,in its current version.

Such members of the Government also determine the list of international professional sporting competitions for the purpose of waiving the obligation of mandatory confinement, regardless of the origin of the respective participants.

Thus, under the combined terms of paragraph 1 of article 18, paragraph 1 of article 19, paragraph 1 of article 27 and article 29 of Decree-Law no. 169-B/2019, of December 3, in its current wording, and of articles 27, 29 and 31 of the regime attached to the Resolution of the Council of Ministers No. 114-A/2021, of 20 of August, the Minister of State and Foreign Affairs, the Minister of National Defence, the Minister of Internal Administration, the Minister of Health and the Minister of Infrastructure and Housing determine:

1 – Approve, in Annex I to this Order, of which it is an integral part, the list of countries whose origin determines that passengers on flights and citizens traveling by land, sea or river must comply, after entering Portugal continental, a period of prophylactic isolation of 14 days, at home or in a place indicated by health authorities.

2 – Without prejudice to the provisions of paragraph 1 of article 5 of Decree-Law no. 54-A/2021, of 25 June, which allows travel, for any reason, to Portugal for travelers provided with an EU COVID Digital Certificate, citizens who, according to paragraph 3 of article 6 of that diploma, are holders of the EU COVID Digital Certificate for vaccination or recovery are exempt from complying with prophylactic isolation.

3 – Approve, in annex ii to this Order, of which it forms an integral part, the list of countries, special administrative regions and territorial entities and authorities not recognized as countries by at least one Member State, whose epidemiological situation is in agreement with Recommendation (EU) 2020/912 of the Council, of 30 June 2020, and respective updates, whose air traffic to and from mainland Portugal is authorized, for the purposes of non-essential travel, subject to confirmation of reciprocity.

4 – Allow non-essential travel to and from the United States of America and to and from Brazil.

5 – Approve, in annex iii to this order, of which it forms an integral part, the list of international professional sporting competitions, whose participation exempts the respective passengers on flights to mainland Portugal from the obligation to comply with a period of prophylactic isolation of 14 days , provided that the other conditions provided for in subparagraph b) of paragraph 3 of article 29 of the regime attached to Council of Ministers Resolution no. 114-A/2021, of 20 August, are observed.

6 – Appendices i and iii to the present order may be updated according to the evolution of the epidemiological situation, by order of the Minister of State and Foreign Affairs, the Minister of National Defense, the Minister of Internal Administration, the Minister of Health and the Minister Infrastructure and Housing.

7 – This order takes effect from 00:00 on September 1, 2021 and until 23:59 on September 16, 2021, and may be revised at any time, depending on the evolution of the epidemiological situation.
